After the respect at work review Fairwork Act amended the definition of sexual harassment. A person sexually harasses another person in the workplace if they are making an unwelcome sexual advance to another person, or asking an unwelcomed request for sexual favour or engaging in other unwelcome conduct of a sexual nature. For a person to have sexually harass someone, it has to be reasonable to expect that in the situation, there’s a possibility that their behaviour would upset, embarrass or frighten the other person.Â
